It is important to plan for your future and security as well as for those you care about.  Our attorneys at Lexow, Berbit & Associates, P.C. assists in the preparation of Simple Wills, Complex Wills, Trusts, Durable Powers of Attorney, Health Care Powers of Attorney, Guardianships, Probate, and Intestacy/Administration.

Wills

It is important for everyone to have at the very least a simple will (“Last Will and Testament”) stating how one wishes to have their property divided when they pass.   Our lawyers understand that it can be a difficult topic to think of and discuss, are there to help you through the process and answer any questions you may have.  If you need a more complex will drafted, our attorneys can assist you with that as well.

Trusts

A trust is the placing of ones property under the control of another, usually for the benefit for a third party.  The management of a trust can be in whatever manner you desire and can be set up for many different purposes.   Our attorneys will help you do so and ensure the security of your property.

Durable Powers of Attorney

A durable power of attorney (a.k.a. “Power of Attorney” of “POA”), is a legal document that authorizes one person to act on the behalf of another.  It may be as limited or as broad as one would like.  This is common not only in Wills and Estates, but also in business where there is a principal and agent relationship.

Health Care Power of Attorney

A health care power of attorney (or “health care proxy”) is a legal document similar to the durable power of attorney, but is limited to your medical care.  The principal (you) selects another individual to act on your behalf in the event  that you are not able to do so on your own volition concerning health care decisions.

Living Will

A legal document that is separate and distinct from the Will and ceases upon death, setting forth how one wishes to receive medical treatment under certain conditions.  Often times this document is executed simultaneously with the health care proxy.
